Partnership Agreement – Tenancy Agreement – Rent – Fraud – Jurisdiction – Contract – Arbitration Clause
This case involved a partnership agreement to invest in land where it was later claimed the plaintiff had been fraudulently tricked into renting their property below market value. A key issue whether the Dubai court had jurisdiction because of an arbitration clause.
Background
On 1-1-2003, some parties entered into a partnership agreement to invest in land owned by the plaintiff and some professional licenses.
A dispute between the plaintiff and the defendant on the implementation of this agreement arose after the plaintiff discovered that they had been tricked into signing a lease contract for the land owned by him and the buildings on it at a low price of not more than 90,000 AED which was not commensurate with the market value of buildings, which were worth six million AED.
