Background
Some Plaintiffs, as a normal consumer, had previously purchased a car from a merchant. The car got into an accident and the accident demonstrated the car had an inherent fault in its safety systems.
The accident had resulted in damages to the Plaintiffs and the car, in addition to demonstrating that the car had an inherent fault.
The Plaintiffs proceeded to file their case for compensation for both damages and an inherent fault against the Defendants, as the merchants who sold them the car, under roll (2622/2003).
The Defendants then proceeded to challenge the suit on the basis of a time bar of six months from the date of the sale of the car, which had passed, according to Article (111) of Federal Law No. 18/1993.
The Court of First Instance dismissed the Plaintiffs' claim based on the existence of a time bar.
