DCC 235/2005

This case involved civil compensation owed to a victim of attempted manslaughter. Key issues included the amounts those convicted in the criminal case should each pay. The case also looked at whether it had been correct for the court to increase the amount due on appeal because there had been medical costs not previously taken care of.

Background

The Public Prosecution accused the First Respondent in the crime No. 2766 of 2002 of deliberately trying to kill the victim (the Appellant) by stabbing him with a knife t he had prepared for that purpose. The First Defendant was accompanied by a group of people who assaulted the victim.

In the trial session, the victim claimed payment of 10,000 AED for temporary compensation. On 15-12-2002, the Criminal Court sentenced the accused to one year in prison after holding the absence of an intent to kill, and ordered the referral of the case to the competent civil court for adjudication.

The civil action was registered under the No. 73/2003. The Plaintiff amended the amount claimed and requested that other opponents join the case with the First Respondent to be charged and jointly pay
