DCC 218, 248/2006
Background Facts
Under a contract dated 14-9-1998 a Defendant company entrusted the Plaintiff to build two warehouses and an external building with a fence in exchange for one million AED.
In accordance with the contract, the Plaintiff filed the drawings and plans for the project and arranged the building permits but was then surprised by the request of the employer through the consultant engineer of the project to stop the work.
The Respondent company cancelled the contract on its own and refrained from paying the first instalment of the contract as stated above without right.
The Plaintiff filed the claim requesting 100,000 AED and interest of 9% per annum from the date of the claim until the completion of payment.
The Defendant company's agent refused to accept the case since it was submitted against someone with a lack of interest.
