This case involved a petition to review a decision. The Court of Cassation had partially reversed the judgment issued by the Appeal Court on the validity of the seizure of the vessel and rejected the appeal otherwise. Therefore, this judgment could not be challenged by way of a petition for review.

Background Facts

The Court of First Instance ruled in favour of a petitioner and obliged the Defendant to pay him $ 1,100,000 for outstanding wages of repair and maintenance work which had been carried out for the Defendant. The Defendant appealed this judgment.

The Court of Cassation reversed the contested judgment on the part concerning the validity of the seizure of a vessel and rejected the appeal otherwise. The Court referred the matter to the Appeal Court on the part that it had reversed. The institution filed grievance.
