The claimant worked as a petroleum engineer for a number of years for the defendant company. On the 7 January 2004, the claimant received a notification of dismissal without acceptable reason or justification. The claimant therefore launched an action for arbitrary dismissal. The case went before the Labour Department first and was then referred to the court. The claimant was seeking damages of AED 604,279.20 as deductions and taxes, and AED 834,705 as end-of-service gratuity. The court agreed in part with the claim and awarded the claimant AED 111,294.25 as compensation for the arbitrary dismissal.
