DCC 91/2005

The original dispute involved a claim for unpaid dues by an employee who had been dismissed. A key issue in this case was whether it was right for an old ruling to be adopted without new reasons being given. It was because the original ruling had been rejected because the board which had issued the ruling was not the same as the one which heard the pleading.

Background

An employee filed a case against a company and requested the court order the company to pay her 52.732 Dirhams and annual interest. The employee stated that she had started working with the company on 02/10/2003 and was dismissed on 01/11/2003. The employee stated the company had refused to pay her dues.

The court ruled that the company should pay the employee 42.148 AED and 9% annual interest.

The company appealed the ruling before the court of appeal and requested the court to order the employee to swear an oath before the judge. The court changed the appealed ruling and ruled the company should pay the employee 36.348 AED and the value of a flight ticket.
