DCC 89/2004

This case involved an employee who made a claim for dismissal and unpaid dues. The case had been rejected because the employment contract was a simulated one. However, the employee had provided suitable evidence of a real employment relationship with the company.

Background

An employee filed a case against a company and its owner and requested the court order them to pay 651531.73 AED and 9% annual interest. The employee stated he had started working with the company on 30/09/1996 and was dismissed from his job on 01/10/2001. The employee stated the company had refused to pay his dues.

The court rejected the case against the owner and ruled the company should pay the employee 202872.8 AED and 9% annual interest.

The employee and the company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.
