DCC 77/2004

The initial dispute involved the request of a British Christian for a divorce from a Malaysian Hindu wife. British law was used to judge the case and the key issue was whether there were grounds under that for divorce because of unreasonable behaviour. The case also looked at whether there had been sufficient evidence of the wife's activities and if it was correct to rule the action had been relinquished.

Background

The Respondent filed suit No. 36/2002 against the Appellant requesting the Court divorce him from his wife and give him custody of his two minor children until they reach the age of majority on the basis of the fact that he was a British citizen and a Christian married to a Malaysian defendant who was a Hindu, and gave birth to two. Five months ago, his wife had displayed strange behaviour including late night working, neglecting her marital home and daughters and staying out until 4 am and increasing her alcohol abuse.
