This case involved an employee who unsuccessfully tried to claim for unfair dismissal although there was insufficient evidence of this. A key issue was whether they deserved severance pay. A letter in which the employee had stated he was closing the company sent to the partners was considered as notice even though they had not replied to it.

Background

An employee filed a case against a company and requested the court order the company to pay him 284.360 AED and annual interest. The employee stated he had started work with the company on 2511/1998 and was dismissed on 30/08/2003. The employee stated the company had refused to pay his dues.

The company requested the court to order the employee to pay 291.151 AED.

The court ruled the company should pay the employee 35.220 AED, 9% annual interest and the value of a flight ticket.

The court rejected the company's request.

The employee and the company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the employee should pay the employee 115.433 AED and 9% annual interest.
