Road Traffic Accident – Damages – Insurance – Drunk Driver – Compensation – Criminal Liability
This case involved a multiple car pile up where the first driver had been drink driving and the other driver had been driving too close. Key issues included the impact of criminal liability and calculation of the compensation.
Background
The Appellant filed suit No. 563 of 2003 before the Dubai Court of First Instance against the Respondent requesting they pay 60,000 AED and 9% interest from the date of the legal claim until full repayment based on the fact that a car collided with car No. 76134 owned by the Plaintiff, which resulted in damages estimated at 60,000 AED. Since the first car that caused the accident was insured by the Defendant insurance company and they refused to pay compensation for the injury suffered by the Plaintiff, they filed his claim.
