Background
The Plaintiff, a divorced woman, sought the Sharia Courts' confirmation of her divorce from her husband under case (252/2004) stating that while she and her husband where in Beirut he had expressly divorced her three times by shouting (you are divorced) three times, subsequent to a similar occurrence in Dubai too.
The Defendant alleged that he was at a state of absolute anger and his intention was not to actually divorce the Plaintiff and that he had not intended to repeat the divorce declaration for three times, but was simply reiterating the same thing.
The Sharia Court of First Instance did not accept the Defendant's narrative and allowed the Plaintiff's case.
The Defendant proceeded to appeal the decision to the Dubai Court of Appeal under roll (169/2004), which also dismissed his appeal.
Accordingly, the Defendant proceeded to appeal the decision to the Dubai Court of Cassation.
