Background
An employee filed a case against a company and requested the court order the company to pay him 36395 AED. The employee stated he had started working for the company on 01/12/2002 and was unfairly dismissed on 17/06/2004. The employee stated the company refused to pay his dues.
The court ruled the company should pay the employee 20294 AED, 5% annual interest and the value of a flight ticket.
The company appealed the ruling before the court of appeal. The court changed the appealed ruling on the unpaid salary to 7800 AED instead of 12533 AED.
Decision
The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had insufficient evidence of causation and had violated the right of defence because it had maintained before the court that the employee did not deserve pay in lieu of notice because he had willingly left his job.
