DCC 518/2005

This case involved the non-payment of goods imported by an agency. The agency agreement was not registered but it was still possible to litigate as this issue was a general commercial matter and not specific to agency.

Background

A Claimant, a principal, brought forward a lawsuit against the Respondent, its Agent in another locality outside the UAE, for compensation for products that were imported by the Claimant to the Respondent in the UAE but there was no payment.

The Respondent alleged that the Claim could not be heard since it was inadmissible as the Commercial Agency Agreement between the Parties was not registered in the UAE.

The Court of First Instance approved the Respondent's defence and dismissed the Claimant's Claim; subsequently, the Claimant sought to appeal the decision before the Court of Appeal.

The Court of Appeal proceeded to dismiss the Claimant's appeal. The Claimant proceeded to appeal the decision to the Court of Cassation.
