DCC 287/2005

This case involved a claim by a registered agent that another party had been selling their principals goods in the UAE when they had an exclusive agency. The fact that these products had been bought directly from the representative office of the principal in the UAE and not from overseas made no difference to the breach.

Background

A Claimant brought forward a suit against the Respondent, in the Claimant's capacity as Agent to a company, as products had been sold by the Respondent in the UAE.

The Claimant invoked the Commercial Agencies Law, including, inter alia, the protection of prohibiting the importation of products by a non-Agent.

The Respondent defended its position by claiming it had not actually imported any of the products, but actually purchased them directly from the Principal's representative office in the UAE.

The Court of First Instance awarded the Claimant part of its Claim and dismissed the Respondent's defenses.

The Respondent appealed the decision, and its appeal was dismissed.
