This dispute involved land handed over to a brother which he did not return when requested and sold part of this land to a third party. Key issues included the compensation as the brother had not been exploiting the land. The oath taken as evidence was also considered along with the impact of the court failing to consider the complaint that part of the land had been sold and if the statute of limitations applied.

Background

The Plaintiff handed over and registered a piece of land Number 338 which was 8913 square feet, to his brother the Defendant, so that he could carry out his work and return it to him on request, but when he demanded the return, he refused.

In appeal No. 7 of 1996 on 14-4-1999, the Defendant was ordered to hand over the plot of land to him.
