This case involved a claim for compensation for unfair dismissal. Initially the case was rejected as the employee had not filed a complaint with the labour department but it was later referred to the elementary court. The court had been wrong to refuse to investigate the case when the employee had maintained he had been unfairly dismissed.

Background

An employee filed a case against a company and requested the court order the company to pay him 57885 AED and annual interest. The employee stated he started work with the company on 05/08/2001 and was dismissed on 06/01/2003 without justification. The employee stated the company had refused to pay his dues.

The court rejected the case because the case documents revealed the employee had not filed a complaint with the labour department.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and referred the case to the elementary court.

The court ruled the company should pay the employee 8000 AED and annual interest 9%.

The employee and the company appealed the ruling before the court of appeal. The court rejected the two appeals and upheld the appealed ruling.
