Judge – Litigation Procedure – Appeal – Unpaid Dues – Resignation
The original dispute involved an employee who had not been paid his dues after resigning. The key issue in this case was whether a judge who had been involved at an earlier stage could be involved at the appeal stage.
Background
An employee filed a case against a company and its owner and requested the court to order the company to pay him 48269 AED and annual interest. The employee stated he started working with the company on 14/05/2002 and resigned because the company had refused to pay his dues.
The court ruled the company should pay the employee 42494 AED and 9% annual interest.
The company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 37127 AED and upheld the ruling on the other points.
