Evidence – Court – Ruling – Employee – Unpaid Salary – Resignation – Appeal – Court Fees
This case had involved an employee who had resigned because his salary had not been paid. The company was able to successfully argue they had had all the evidence to prove their case but had not been able to present it before the issue of the ruling. The court should have given them the opportunity to present it.
Background
An employee filed a case against a company and its owner and requested the court to order them to pay him 138054 AED and 9% annual interest. The employee stated he had started working with the company on 24/05/2000 and had resigned from his job on 01/11/2001 because the company had refused to pay his salary.
The court ruled that the company and its owner should pay the employee 18000 AED and 9% annual interest.
The employee and the company and its owner appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 13000 AED.
Decision
The company and its owner appealed the ruling before the court of cassation (Appeal No. 174/2003) and (Appeal No. 171/2003).
