DCC 167/181/2004

The original dispute involved a claim for unpaid dues by an employee who had been dismissed. The employee tried to argue he had not been correctly notified of the case. This was irrelevant as he had been unable to put forward a defence. The employer should have been awarded legal fees as they had been the winning party.

Background

An employee filed a case against a company and requested the court order the company to pay him 238904 AED and 9% annual interest plus return his passport. The employee stated he had started working with the company on a three-year contract on 19/05/2002 and was dismissed on 01/05/2003. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee 126433 AED and 9% annual interest plus the value of a flight ticket.

The employee and the company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

Decision

The employee and the company appealed the ruling before the court of cassation (Appeal No. 167/2004) and (Appeal No. 181/2004).
