DCC 163/2004

This case involved a claim for unpaid dues including salary by an employee. The court had been wrong to order the employer to pay an amount which was greater than the employee's request.

Background

An employee filed a case against a company and requested the court to order the company to pay him 2002234750 AED and annual interest. The employee stated that he had started working with the company on 31/08/2000 and was dismissed from his job on 28/01/2002. The employee stated the company had refused to pay his dues.

The company requested the court to order the employee to pay 117290 AED and annual interest.

The court ruled the company should pay the employee 117854.05 AED and 9% annual interest plus the value of a flight ticket.

The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 27974.87 AED and 9% annual interest plus the value of a flight ticket.

The company introduced a plea to the court of appeal. The court rejected the plea.
