This case involved an employee who had begun working for an employee on a definite period employment contract which had been extended. He had then been unfairly dismissed and his dues had not been paid. The employer argued the employee had tried to claim salary differences over specific periods but had not identified the actual years.

Background

An employee filed a case against a company and requested the court to order the company to pay him 69450 AED and annual interest. The employee stated he had started working with the company under a definite-period contract and continued working after the termination of the contract. The employee stated he was then unfairly dismissed on 19/05/2003 and the company refused to pay his dues.

The court ruled that the company should pay the employee 64950 AED and 9% annual interest.

The company appealed the ruling before the court of appeal and requested the court order the employee to swear before the judge. The employee swore before the judge. The court changed the appealed ruling and ruled the company should pay the employee 54450 AED and the value of a flight ticket.
