DCC 131/2004

This case involved a claim for unpaid dues by an employee who had been unfairly dismissed. The case was taken against the company and company owner. It was argued that under freezone law a company could be owned by one person. Such companies have no independent financial disclosure from their owner and so the owner can be a party in the dispute.

Background

An employee filed a case against a company and its owner and requested the court to order them to pay him 103000 AED. The employee stated he had started working with the company on 25/10/2001 and was unfairly dismissed on 08/10/2003. The employee stated that the company had refused to pay his dues.

The court ruled that the owner should pay the employee 79483 AED and rejected the other requests.

The employee the company and the owner appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case against the owner.
