DCC 127/2004

The original dispute involved a claim for unpaid dues by an employee who had been dismissed. The key issue in this case was whether the expert was obliged to directly speak to both parties. It was confirmed the expert's task was a supplementary one.

Background

An employee filed a case against a company and its owner and requested the court order them to pay 172000 AED and annual interest. The employee stated he had started working with the company on 10/07/1993 and was dismissed from his job on 02/07/2000.

The company and the owner requested the court to order the employee to pay 52016.48 AED and the annual interest.

The court rejected the two cases.

The company and its owner and the employee appealed the ruling before the court of appeal. The court upheld the ruling.

Decision

The company and the owner appealed the ruling before the court of cassation. The court repealed the ruling and referred the case to the court of appeal.

The court of appeal referred the case to the elementary court. The court ruled that the employee should pay 52013.48 AED and 9% annual interest.
