Employment Case – Litigation Procedure – Jurisdiction – Collective Case – Unfair Dismissal – Labour Court
This case was a claim for unfair dismissal. The employer argued the Labour Court did not have the authority to hear the case as it was a collective one. The court ruled the case was an individual case.
Background
An employee filed a case against a hotel and requested the court to order the hotel to pay him 20499 AED, annual interest and the value of a flight ticket. The employee stated that he had been unfairly dismissed from his job and had not received his dues.
The court ruled the hotel should pay the employee 18056 AED, the value of a flight ticket and 9% annual interest.
The employee and the hotel appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the hotel should pay 9300 AED for late salary and 10000 AED in compensation.
