DCC 70/2004, 72/2004

This case involved a claim by an employee for unpaid dues. The employer tried to argue the employee's witnesses had not provided sufficient proof overtime had been carried out but the court had awarded it. It was within the court's authority to do so. The employee however had not provided sufficient evidence he had had to pay housing and transport costs.

Background

An employee filed a case against a hotel and requested the court order the hotel to pay him 102135 AED and annual interest. The employee stated he had started working with the hotel on 01/012001 but the company had refused to pay his dues.

The court ruled that the hotel should pay the employee 49500 AED and 9% annual interest.

The employee and the hotel appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the hotel should pay the employee 35250, 31 AED and 9% annual interest plus the value of a flight ticket.

The employee and the hotel appealed the ruling before the court of cassation (Appeal No. 70/2004) and (Appeal No. 72/2004).
