Background
The Claimant, a Syrian national domiciled in the UAE, contracted with the Respondent in order to be appointed as an exclusive agent for the Respondent in the UAE, Iran, the GCC, the Middle East and Russia to distribute as the Respondent's products in the geographical area.
As part of the Agreement, the parties agreed that the Claimant would receive a net of 16% of the sales' revenue from the Respondent for its agency and distributorship efforts; and the percentage was calculated periodically on monthly basis.
On 19/11/2000, the Respondent served the Claimant with notice of termination informing the Claimant of its wish to discontinue their arrangement and finalize and settle any remaining amounts outstanding.
Consequently, the Claimant filed a suit before the Dubai Court of First Instance under Judicial Roll Number (131/2001) petitioning the Court to mandate and appoint an accounting expert to calculate the amounts outstanding on account of its sales of the Respondent's products.
