DCC 48/2004

This case involved a claim by an employee for compensation for unfair dismissal. The company successfully argued the employee had resigned before the payment of his August salary. As a result the company's two day delay in paying this salary was not considered to be non-payment of salary which would have meant he had been unfairly dismissed.

Background

An employee filed a case against a company and requested the court order the company to pay him 24115 AED and annual interest. The employee stated he had started working with the company on 18/01/1984 and was dismissed on 02/09/2002 without justification. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee 20005 AED and 9% annual interest plus the cost of a flight ticket.

The employee and the company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
