This case involved the calculation of compensation for an employee on a fixed term contract whose service had been terminated before the end of the contract period.

Background

An employee filed a case against a hospital and requested the court to order the hospital to pay her 87.702.50 AED and annual interest. The employee stated she had started working with the hospital under a two-year contract from 11/07/2000 until 10/07/2002. The employee stated the contract was renewed for an additional two years but she was then dismissed. The employee stated the hospital had refused to pay her dues.

The court ruled that the hospital should pay the employee 45545 AED and the value of a flight ticket plus 9% annual interest.

The employee and the hospital appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the employee deserved 13702 AED in overtime and changed the value of the compensation to 8400 AED.

The employee and the hospital appealed the ruling before the court of cassation (Appeal No. 35/2004) and (Appeal No. 49/2004).
