Personal Injury – Work Place Injury – Compensation – Court Authority – Interest
This case involved compensation for an employee who had been injured at work. The two key points were whether the court had the authority to assess the amount of the compensation and the date from which interest should be calculated.
Background
An employee filed a case against a hotel and requested the court order the hotel to pay him 120000 AED and annual interest. The employee stated he had started working with the hotel on 16/11/2001 and had been injured during his work on 21/01/2002. The employee stated he had a 45% disability.
It was ruled that the hotel should pay the employee 10800 AED and annual interest of 9%.
The employee and the hotel appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the hotel should pay the lawyer's expenses of 600 AED and upheld the ruling on the other points.
