DCC 196/2003

This case involved a claim for unpaid salary over a period of 10 months. The key issue in this case was whether it was the employee or employer's responsibility to prove the employee had worked during this period. There was evidence of the employment relationship and the employer had admitted this relationship existed, so were responsible for proving the employee had not worked for them during this ten month period.

Background

An employee filed a case against a company and requested the court to order the company to pay him 20520 AED and annual interest. The employee stated he had worked with the company for six years before being dismissed. The employee stated the company had refused to pay his salary for over ten months.

The court ruled that the company should pay the employee 16250 AED and 9% annual interest.

The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 6250 AED and upheld the appealed ruling on the other points.
