Unpaid Salary – Statute of Limitations – Dismissal – Dues – Holiday pay
This case involved an employee who had worked for a company for 28 years and claimed that for four years he had not received his full pay and holiday entitlement. He had then been dismissed. The company successfully argued it should not have to pay unpaid amounts for salary that fell due before one year from the filing of the case. This was accepted.
Background
An employee filed a case against a company and requested the court to order the company to pay him 205050 AED and annual interest. The employee stated he had started working with the company on 02/07/1976 and had worked for it for 28 years. However, since 1999 the company had not paid his salary in full and they had refused to give him holiday for four years. The employee stated the company had unfairly dismissed him and refused to pay his dues.
The court ruled the company should pay the employee 97.750 AED and 9% annual interest plus the value of a flight ticket.
