DCC 183/2003

The original dispute involved a claim for unpaid dues by an employee on an indefinite period contract who had resigned and given notice. The key issue was whether the correct litigation procedure had been followed. The employee claimed a letter from the Freezone Authority confirmed the employee had made a request to receive his dues and that the authority had referred the case to the court.

Background

An employee filed a case against a company and requested the court to order the company to pay him 155118 AED and annual interest. The employee stated he had started working for the company on an indefinite-period contract and had resigned on 24/04/2001 after giving notice. The employee stated the company had refused to pay his dues.

The court rejected the appeal.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case because it had not been filed with the relevant labour department.
