DCC 182/2003/1

This case involved the way severance pay should be calculated for an employee. The company correctly argued days on which the employee was absent and was not paid salary should not be included in the calculation.

Background

An employee filed a case against a company and requested the court to order the company to pay him 62119 AED and annual interest. The employee stated he had worked with the company from 18/06/1992 to 20/06/2002.

The company requested the court order the employee to pay 42224 AED and clear two debts.

The court ruled the company should pay the employee 46419 AED and 5% annual interest plus the value of a flight ticket.

The court rejected the company's case.

The company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 45819 AED.

Decision

The company appealed the ruling and stated in its grounds of appeal that the ruling had erred in the application of law because the court had ruled the employee deserved severance pay and had included days on which the employee was absent.
