Unfair Dismissal – Employee – Compensation – Calculation – Contract of Employment – Remaining Period – Definite Contract
This case involved a claim for compensation by an employee who had been unfairly dismissed. The key question was how compensation should be calculated as the employee had a contract for a definite period and more than three months' remained.
Background
An employee filed a case against a company and requested the court order the company to pay them 94084 AED and annual interest. The employee stated he had started working with the company as a sales manager but had been unfairly dismissed. The employee stated the company had refused to pay his dues.
The court ruled that the company should pay the employee 59880 AED and 9% annual interest plus the value of a flight ticket.
The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 74880 AED but upheld the appealed ruling on the other points.
