The original dispute involved a claim for unpaid dues by an employee who had been dismissed. The key issue in this case was the evidence. The employer had asked to be able to present original documents to the court. This had been wrongly rejected as the employee had denied these documents were correct the employer should have been given the opportunity to prove their defence.
Background
An employee filed a case against a company and requested the court to order the company to pay him 51600 AED and return his passport. The employee stated he had started working with the company on 02/08/1999 and was dismissed. The employee stated the company had refused to pay his dues.
The legal representative of the company requested the court to order the employee to pay 11250 AED and annual interest.
The court rejected the company's request and ruled the company should pay the employee 18087 AED and return the employee's passport.
The company and the employee appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled tthe company should pay the employee 35560 AED.
