Persons affiliated to the respondent are people excluded from the insurance coverage, in case of having an accident during work, or due to thereof, because of the use of the insured car. The ruling of the contested judgment to order the insurer to pay out the compensation, without considering the defense that the Insurance Policy does not cover employees of the owner insured vehicle and the accident took place during work and due to thereof, shall be deemed an error in the application of law and shall necessitate its cassation.
