DCC 51, 69/2003

This case involved a claim by an employee who had been dismissed for his dues. The court had been wrong to ignore the employer's defences which showed they had reasons for dismissing the employee and it was not unfair.

Background

An employee filed a case against a company and requested the court order the company to pay him 44.620 AED and annual interest. The employee stated he had started working with the company on 10/04/2000 and was dismissed from his job on 16/09/2001. The employee stated the company had refused to pay his dues.

The court ruled that the company should pay the employee the value of a flight ticket and 9% annual interest.

The employee appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 15000 AED, 9% annual interest and the value of a flight ticket.

Decision

The company and the employee appealed the ruling before the court of cassation (Appeal No. 51/2003) and (Appeal No. 69/2003).

In Appeal No. 69/2003: The court rejected the appeal in form because it had not been filed within the legal deadline.
