This case involved the extent to which a commission agent was liable for damage to transported goods.

Background

A company filed suit No. 400 of 2000 before the Dubai Court of First Instance against two other companies, requesting 7145649 AED and interest. The Plaintiff explained that based on a quotation from the First Defendant, they shipped a number of glass panels from Jakarta to Dubai on one of the Second Defendant's planes. The shipment was damaged during the transfer, and the Plaintiff was told that similar goods would be sent again from the supplier. The delay caused the termination of the claimant's contract with the contractor and additional charges, and the total loss of the claimed.

Court of first instance - Decision 7/10/2001

The Court of First Instance decided to dismiss the case for the first Defendant and obliged the Second Defendant to pay the Plaintiff 35,569 AED and 9% interest per annum from the date of the lawsuit on 18 7.2000 until full payment. The Second defendant appealed this judgment by appeal No. 1431 of 2001 and the Plaintiff appealed it by appeal No. 1436 of 2001.
