Dismissal – Termination of Employment – Severance Pay – Unpaid Salary – Resignation
This case considered whether an employee deserved severance pay. The company correctly argued he did not as they were able to deny he had not been paid his salary and had left his job voluntarily.
Background
An employee filed a case against a company and requested the court to order the company to pay him 93854 AED and annual interest. The employee stated he had started working with the company on 08/03/1997 and was dismissed on 30/04/2002.
The court ruled that the company should pay the employee 61754 AED and the cost of a flight ticket plus 9% annual interest.
The company appealed the ruling before the court of appeal and requested the court order the employee to swear before the judge. The employee swore and the court changed the appealed ruling and ruled the company should pay the employee 57854 AED and the cost of a flight ticket.
