DCC 269/2003
This case involved a provisional seizure of amounts owed to DEWA. A key issue was whether if there was a delay in paying the fee, the complaint was considered as not being filed within the relevant time.
Background
The Respondent (Plaintiff in the first instance) filed a petition to the judge of urgent matters at the Dubai Court of First Instance on the seizure of the receivables of the Appellant company for the Dubai Electricity and Water Authority up to 78 / 4,036,121 AED, and registered this application number 2585/2001,
When the judge refused to issue the seizure order, the Plaintiff company complained against his judgment
On 26.12.2001, the Court ordered the cancellation of the order and the acceptance of the provisional seizure of the dues of the Respondent company for the Dubai Electricity and Water Authority within the amount stated in the application.
