DCC 247/2003

This case involved a woman whose husband had life insurance as a result of journal membership. She had renewed the subscriptions annually. Key issues included when the date of death would be if there was brain death and if a life insurance contract was automatically renewed on payment of the subscriptions.

Background

An Appellant filed the action No 02/2002 against the Defendants demanding they jointly pay 125,000 AED with legal interest of 12% as of the maturity date until payment on the basis that her husband before he died had a membership of the journal issued by the First Defendant which gave him and his Appellant wife insurance for life at the Second Defendant insurance company worth 125,000 AED for his natural death and 250,000 AED if the death was caused by an accident and the wife kept his membership and renewed it annually as of 16/01/1993 and until 29/09/1999 where the husband died due to a heart attack even though the medical procedures continued until 15/10/1999 which meant that he died during the insurance coverage on 29/09/1999 and so she was entitled to the insurance money.
