DCC 223/2003

This case involved a claim for compensation from an employee who was injured and disabled at work. As they did not blame the employer for the injury it was classed as an employment and not a tort case.

Background

A Respondent filed suit No. 914/2001 against the two Respondents companies, requesting they pay 35,000 AED on the basis that he worked for the First Defendant Company and t on 21/5/2001 his right wrist was injured at work, which caused him permanent disability. The company should be held liable along with the insurance company to compensate him for this injury.

Proceedings:

Court of first instance - Decision 28/10/2002

The Court of First Instance dismissed the case on the basis that the lawsuit was filed without resorting to the competent labour department. The Plaintiff appealed this judgment.

Appeal Court - Appeal No. 1273/2002 - Decision dated 9/3/2003

The Appeal Court confirmed the appealed judgment. The Appellant appealed further.
