DCC 201/2003

The original dispute involved unpaid workers' salaries. The key issue was whether it was possible to contest the validity of the power of attorney of an opponent's lawyer.

Background

A company filed action No 169/2000 against an Appellant demanding he pays 114,650 AED with interest as of the date the action was filed until payment.

The amount demanded represented the value of the contracting workers' salaries.

Proceedings:

Court of First Instance | Decision taken on 28/02/2002

The court appointed an expert and after he deposited his report, the court decided on 28/02/2002 to give the company its requests.

Court of Appeal - Appeal No 313/2002 | Decision taken on 26/01/2003 | Appealed Judgment Confirmed

Appeal in Cassation before the Dubai Court of Cassation

The Appellant claimed that the contested judgment contravened the law because he had pleaded before the court of appeal that the appealed judgment was void for following nullifying procedures because the power of attorney of the lawyer who filed the action and represented the Respondent before the Court of First Instance, dated on 03/08/1998, was issued by the Plaintiff in his personal capacity and not in his capacity as the attorney of the Respondent.
