This case involved an employee's rights to end of service gratuity. The key issue considered was the correct procedure for notification of an oath and when an oath was considered to have been refused.

Background

A Respondent filed the action No 757/2001 against the Appellant demanding 35,953 AED on the basis that he used to work for them since 18/10/1994 as a carpenter with a monthly salary of 690 AED.

On 11/06/2001, they were unfairly because they refused to waive their working rights which they refused to pay him and which was equivalent to the demanded amount. Since the labour department could not solve the issue amicably it was referred to the court.

On 22/12/2001, the court decided to reject the plea of non-competence to look into the action, to order the Defendant to pay 10,909/96 AED and rejected the rest of the requests.
