Unfair Dismissal – Dues – Holiday Pay – Evidence
The original dispute involved a claim for unpaid dues including holiday pay by an employee who had been dismissed. The employer tried to argue the employee had admitted he did not deserve holiday pay. The court confirm the employer was responsible for proving the holiday pay had been given.
Background
An employee filed a case against a company and requested the court to order the company to pay him 150395 AED and annual interest plus give him a certificate of experience. The employee stated that he had started working with the company on 01/03/2000 and was unfairly dismissed on 11/10/2002.
The court ruled the company should pay the employee 49622 AED and 9% annual interest plus the value of a flight ticket and provide him with a certificate of experience.
The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled that the company should pay the employee 56995.50 AED and the value of a flight plus 9% annual interest.
