This case involved an employee who had been dismissed after being accused of dishonesty and had not been paid his dues. The employer tried to argue the court had been wrong to refuse their request to refer the case to investigation. A key point was whether the ruling contradicted the defence.

Background

An employee filed a case against a pharmacy and requested the court order the pharmacy to pay him 80560 AED and annual interest. The employee stated he had started working with the pharmacy on 10/01/1999 and was dismissed on 14/05/2000 after being accused of dishonesty. The employee stated the pharmacy had refused to pay his dues.

The pharmacy requested the court to order the employee to pay 8000 AED and annual interest.

The court ruled that the pharmacy should pay the employee 3667 AED.

The employee and the pharmacy appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the pharmacy should pay 31647.14 AED and 9% annual interest plus the value of a flight ticket.
