DCC 102/2003
Background
An employee filed a case against a company and requested the court to order the company to pay him 157030 AED and annual interest. The employee stated he had started working with the company on 01/04/1995 and was unfairly dismissed on 16/05/2001. The employee stated that the company had refused to pay dues.
The court ruled that the company should pay the employee 126550 AED and 9% annual interest.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The company appealed the ruling and stated in its grounds of appeal that the ruling had erred in the application of law because the court had rejected the argument that the case should be rejected because of the statute of limitation.
The court stated this argument was valid because Federal Law No. 8/1980 stipulated that the case should not be considered if one year had passed from the due date.
