Unfair Dismissal – Flight Ticket – Transfer of Employment Location – Employment Contract
This case involved an employee who had resigned and claimed his dues including the value of a flight ticket. A key issue was whether the employee had resigned or had been unfairly dismissed as the company had changed his employment location. This was contrary to the contract so it was unfair dismissal.
Background
An employee filed a case against a company and requested the court order the company to pay him 134093 AED. The employee stated he had started work on 09/08/1998 and had resigned on 02/06/2001. The employee stated the company had refused to pay his dues.
The court ruled the company should pay the employee 85249 AED and 9% annual interest plus the value of a flight ticket.
The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 90658 AED and upheld the appealed ruling on the other points.
