DCC 142/2001

The original dispute involved a claim for unpaid dues by an employee who had been dismissed. The key question in this case was whether it was illegal for the judge to request one of the parties to swear an oath. It was confirmed one party can request the court to order the other party to swear before the judge.

Background

An employee filed a case against a pharmacy and requested the court to order the pharmacy to pay him 77475 AED and the annual interest. The employee stated he had started working with the pharmacy on 20/12/1997 and was dismissed from his job on 22/06/2000.

The court rejected the case.

The employee appealed the ruling before the court of appeal and requested the court order the defendant to swear before the judge. The defendant did not attend the session.

The court abandoned the appealed ruling and ruled the pharmacy should pay the employee 77475 AED and 9% annual interest.
